Will of Buckminister McGuire
(note: the following is only a portion
of a lenghthy file. I didn't include the testimonies of witnesses
and the repeating of the will to each witness along with letters assigning
the executrix. I did include the petition for letters of testimony
since it listed places of residence for parties involved.)
I, Buckminster MCGUIRE, of
Beattyville, Lee County, Kentucky, being of sound and disposing memory,
do make and publish this my last will and testament, hereby revoking all
others. Thsi is to say: First: I desire that all my just
debts and funeral expenses be first paid out of my estate after my decease.
Second: I give, devise and bequeath to my wife Kate. D. MCGUIRE, all my real and personal property, wherever situated, including all choses in action and all other property of every descripton owned by me at the time of my death, to be her's absolutely and to do with as she may desire, with full power to sell any or all of my property for her own use and benefit, and to make deeds and conveyances and to use all of the proceeds thereof as she may see proper. Third: It is my will and desire that my said wife Kate. K. MCGUIRE, be appointed excutrix of this my last will and testament, and I request that the County Court of Lee County permit her to be qualified as my executris without bond of any kind or without being sworn, and I further request that no inventory of my estate be made. Fourth: My said executrix, Kate D. MCGUIRE, is authorized and empowered to make sale and deeds of conveyances of all of my property as such executrix and as my sole heir and devisee, it being my intention to vest in her individually and as my executrix full and complete title to all of my propery everywhere, real, personal and mixed. 1. That she is the widow of Buckminster MCGUIRE, who died testate on or about the 21st day May, 1938, while he was a resident and citizen of HIghlands County, Florida, leaving an estate, the approximate value of which is more than $1,000.00. 2. The residence of your
petitioner is number 309 Magnolia Street, Sebring, Florida and the name
age and residence of the surviving spouse and sole and only heir at law
of decedent and the relationship to the decedent are as follows:
3. The will of the deceased has been delivered to the county Judge of said county and filed by him. Wherefore: petitioner prays that said will be probated and admitted to record as the last will and testament of the said Buckminster MCGUIRE, deceased; that letters testamentary be isssued to our petitoner, and that no inventory or bond be required of your petitioner as executrix of said will.
