Will of Cleveland Phillips
The Last Will And Testament
of Cleveland PHILLPS
I, Clevelin PHILLIPS, knowing
that life is uncertain and being ill, but sound in mind and disposing memory,
do make and publish this my last will, hereby revoking all other wills.
First: It is my will that all my just debts be fully paid by my executor hereinafter appointed by me.
Second: I will and bequeath to my beloved wife, Bertha PHILLIPS all of my personal property of every kind, to be used by her in such manner as she wants to for her use and benefit.
Third: I will and devise to my beloved wife Bertha PHILLIPS, all my undivided interest in a tract of land on the head of Spruce or Coal Fork of Contrary Creek in Lee County, KY, and I hereby empower her in her name to sell, lease for oil or gas any or all of her said interest in the said tract of land which contains seventy acres and same known as the Aaron Warner Sr. tract and same described in deed from Huntington Land Company and others to Lucinda DUNN, me and others, now of record in the Lee County Clerk's office and she is authorized to receive any and all moneys for any of said land and to make and acknowledge deeds of conveyance for any and all of said lands.
Fourth: I will and devise
to my beloved wife Bertha PHILLIPS all of my undivided interest in the
following boundary of land lying on Little and Big Sinking Forks of Millers
Creek in Lee County, Kentucky and bounded as follows:
Beginning in the Flahaven?
line on Sodam and Gomorrah at a point where the line S___ eighty-five East
line from two sugar trees and two hickories known as Meadows Corner;
thence North nine degrees west with said Flahaven? line to the back
__ North eighty one East line of the John CARNAN patin__ of 29823
acres; thense South eighty and degrees West with said line to the
North-west corner of the said John CARNAN patent; thence South nine
degrees East with the Western line of said Carnan patent until it strikes
the South eighty five East line crossing Sodam and Gomorrah; thence
with said South eighty five East line to the place of beginning at the
Flahaven line near the mouth of Sodam and Gomorrah. and she is authorized
and empowered to sell, lease and convey by deed any and all said interst
in said land, to receive and control the proceeds thereof in her own right.
Fifth: I nominate and hereby appoint my beloved wife Bertha PHILLIPS as my executor herein and hereby authorize and direct that she qualify as such executor herein without given bond.
In witness whereof I have hereunto set my hand and seal in the presents of T. C. FARLEY and Luncinda DUNN, the two attesting witnesses, this December 11, 1918.

I, J. B. HIERONYMUS, Clerk
of the Lee County Court, certify taht the foregoing will of Cleveland PHILLIPS
was on the 13th day of January, 1919, the same being the first day of the
regular January Term, 1919, of the Lee County Court produced in open Court
and filed and offered for probate and at the regular February Term, 1919
of Lee County Court proved by the oaths of T. C. FARLEY and Lucinda DUNN,
the two subscribing witnesses thereto and no exceptions being filed, the
same was ordered for record on the 13th day of February, 1919; whereupon
the same and this my certficate have been duly recorded in my said office
in Will Book No. 1, pages 166, 167 and 168.
