Will of G. W. Cann
I, G. W. CANN of Beattyville,
Lee County, Kentucky being of sound mind and memory, and considering the
uncertainty of this frail and transitory life, do herefore make, publish
and declare this to be my last will and testament, that is to say:
First. After all my lawful debts are paid and discharged I bequeath unto my children, C. B. CANN, Sabina Elizabeth CANN, James B. CANN, Nessie N. CANN, Mark CANN, Thomas H. CANN and Ralph Homer CANN, all my home place where I now live, including, all of same to the righ of way of the Louisville & Nashville rail road as it is now located, and to wet Main street, and with same in the city of Beattyville, Lee County Kentucky. And it is my will that my Executor, hereafter named, hold said property for the use and benefit of all my said Children until my youngest son, Ralph Homer CANN, becomes twenty-one years, at which time I direct my said children to agree and divide said property equally between each then living; but if no such agreement can be had then any or all of them may sell his or her interest, but only after my said son, Ralph Homer CANN becomes twenty-one years of age, should he live to that age. If either of my said children shall depart this life before my said son, Ralph Homer CANN arrives at the age of twenty-one years, then said property shall be equally divided between those surviors, if a divission can be had, if not, then may sell same as herein provided. Second. I bequeath to my Executors, herein after named, all of my other real and personal property of whatever kind and character of which I may die seized and prossessed, empowering and directing them to sell and dispose of any or all of said property, except as set forth in the first paragraph of this my will and testament, as they may see proper fro [sic] the purpose of educating and maintaining my infant children and they are hereby given? power and authority to see and convey the same. Third. Having implicit convidence in the honest and integrity of my son, C. B. CANN and my daughter, Sabina Elizabeth CANN, I hereby appoint them to be executors, and direct that they be allowed to qualify and act as Executors of this my last will and testament without bond, hereby revoking all former Wills by me made. In Witness Whereof, I have hereunto subscribed my name the 16th day of April, in the year of our Lord nineteen hundred and fourteen. G. W. CANN in our presence, and acknowledged by him to each of us; and he at the same time declare the above instrument, so subscribed to be his last Will and Testament; and we, at his request, have signed our names as witnesses hereto, in his presents and in the presence of each other, and written opposite our names our respective places of Residence.
