Will of Jacob C. HOWERTON

I, Jacob C. HOWERTON of Beattyville Kentucky being of full age and of sound mind and memory, do hereby make publish and declare this to be my last will and testament, and being the only one ever made by me.

I.  I direct that all my just debts and funeral expenses be paid out of my estate as soon as practicable after my demise.

2.  I give, bequeath and devise to my beloved wife Susan Francis HOWERTON, who has been my true and faithful companion through the many years of my trials and hardships of life, all the residue (after funeral expenses and just debts are paid) of my estate, real, personal and mixed of every kind and character, visual and contingent wheresoever situate which I may own or have the right to convey or dispose of in any manner at the time of my decease, to pass and vest in her absolutely and in fee simple, with this the only provision that in the event she (my wife) should sell and convey the property (real estate) I am at the present time seized of in Lee County, Kentucky, and all of which is of record in the Lee County Court Clerk's Office, that she from the proceeds thereof pay to Gretchen HOWERTON LOVELACE and Clarence (Ted) HOWERTON or their heirs the sum of Five Hundred ($500.00) Dollars each (Gretchen & Clarence) over and above the distributable share going to each of my other children or their heirs.

I have executed and hereby set my hand at Beattyville, Kentucky all of my free will and accord and without coercion or the influence of others, and that same is my free and voluntary act, this 6th day of May 1931.

Signed by Jacob C. HOWERTON, and by him acknowledged to be his last will and testament, in our presence, sight and hearing, who at his request have hereunto subscribed our names as witnesses in his presence, and in the presence of each other, at Beattyville, Kentucky, this 6th day of May 1931.

I, Thomas C. PRYSE, clerk of the Lee County Court, do hereby certify that the foregoing Will of J. C. HOWERTON, deceased, was on 12th day of December, 1932, at a regular term of the Lee County Court filed in my office the same having been properly proven by the Court in open Court as the law directs; and same having lain over thirty days for exceptions and no exceptions having been taken, same was confirmed and ordered to  record on January 9 1933; whereupon the same with the foregoing and this my certificate have been duly recorded in my said office in Will Book No. 1, page 294.
Given under my hand this 20th day of January, 1933.
