Will of Joseph Thomas
I Joseph THOMAS of Lee County Kentucky being of lawful
age and of sound and dispoing memory realizing upon the uncertainty of
human life and desireing to make suitable disposition of all his Real Estate
and personal property in such away as to insure to him and his wife Elizabeth
THOMAS a suitable maintanance and support during their natural lives and
in consideration of the love and affection he has for his son Joseph S.
THOMAS he said Joseph THOMAS by this his last will and testament doth hereby
give and bequeath to his son Josen S. THOMAS all of that tract of land
lying in Lee County KY on Loges Island branch the waters of the South Fork
of the Kentucky River and known as his home tract of land and embraced
in a deed from G. W. DANIEL Commissioner of the Owsley Circuit Court to
him and he hereby gives and bequeaths to his following named children Lucy
HALL, Harvy THOMAS, George THOMAS, William THOMAS, Millard THOMAS, Sarah
EVE, Joseph S. THOMAS and Cornelius THOMAS all of his household and kitchen
furniture and all other personal property owned by him at his death to
be divided equally between them but it is his will that should his wife
Elizabeth THOMAS survive him she is to have the use control and rents of
all the aforesaid lands and personal property her natural life. It
is also my will and desire that at my death all my cash and cash notes
be equally divided between my aforesaid named children subject to their
use by my wife Elizabeth should she survive me. and at the death
of my self and wife I will and desire that my son Joseph S. THOMAS give
to each of us a decent and suitable burrial and that should I be owing
my debts that he is to pay them without any charge to my other children.
And it is my desire that my son Joseph S. THOMAS care
for and support myself and wife during our natural lives.

An Instrument of writing purporting to be the last Will
and Testament of Joseph S. THOMAS deceased was this day produced in open
Court and proved by the affidavit of Theo. B. BLAKEY. Whereupon it
is ordered that said insturment of writing be and the same is allowed and
is established as the last will and Testament of said Joseph S. THOMAS
deceased and as such is duly admitted to record.

County of Lee
I, D. R.? PENDERGRASS Clerk of the Lee County Court do
hereby certify that the foregoing instrument of writing purporting to be
the last will and testament of Joseph S. THOMAS ith an order of Court admitting
same to Record was this day produced in my office and lodged for record.
Whereupon the same and this my Certificate have been duly recorded in my
said office.
Given under my hand this the 22nd day of Jan 1906
