Last Will and Testament
Know All Men by these Presents I, Robert JAMESON, of Beattyville, Lee County, Kentucky, do make, publish and declare the following as to be my last true will and Testiment, hereby revoking any and all othe wills by me hereto fore made. Item 1. I direct that all my just debts and funeral expenses first be paid out of my Estate as soon as practicable after my decease. Item 2. I give, devise and bequeath all the residue of my Estate, real, personal and mixed wherever situated, to my beloved Beatrice E. JAMESON, for and during her natural life and direct after her decease, that my said wife's just debts and funeral expenses be paid out of my estate. I hereby authorize and empower my said wife, in case of need at her discretion, to encroach upon the corpus of my estate for the maintenacne and support and vest her with full power and authority to sell, convey and deliver such part or parts of my said estate she may deem necessary to dispose of for said purpose, and further authorize her to sell convey and deliver all or any portions of my said estate, at her descretion, for the purpose of reinvesting the proceeds in other property the title thereto to be taken and held by her pursuant to the terms of this my last will and Testament. Item III. After the decease of my said wife I give, devise and bequeath the then residue of my estate to my son son [sic] Robert Earl JAMESON, for and during his natural life, he to Collect and receive the income therefrom but not being authorized or empowered to encroach upon the Corpus thereof. Item IV. Upon the termination of the respective life estates hereinbefore provided for by me, I give, devise and bequeath the residue and remainder of my estate to Jane JAMESON SEXTON and Richard SEXTON Children of my sister Hazel Jameson SEXTON share and share alike, absolutely and in fee simple, except the sum of One Hundred ($100.00) Dollars which I hereby devise and bequeath to my son T. P. JAMESON, which bequest shall constitute a change upon said remainder interest. Item V. I hereby make, nominate and appoint my beloved wife, Beatrice E. JAMESON as and to be the executrix of this my last will and Testament and request that she be permitted to qualify as my said personal representative without surety; and my said Executrix is hereby authorized and empowered to sell, convey and deliver such portion or portions of my real or personal estate in her discretion, which it my [sic] be necessary to dispose of in order to pay any indebtedness against my estate; and my said executrix shall take notice of the fact that one of the assetts of my estate consists of a one-fourth (1/4) interest in the property and assetts of the J. & B. Coal Company, situated at St. Charles in the State of Virginia title to my said interest, being held in his name by my brother, Earl JAMESON for my use and benefit as Trustee. In Testimony whereof witness my signature hereto affixed, in the presence of the witnesses whose names are hereinbelow subscribed, at Richmond, Kentucky, on the 5th day of June 1946. Robert JAMESON Signed and acknowledge by the said Robert JAMESON as and for his last will and testament in our presence, and by us subscribed, as attesting witnesses, at his request and in his presence and in the resence of each other, this 5th day of June 1946.
