ABSTRACT OF THE COUNTY COURT RECORDS OF ESSEX
COUNTY, MASS. 1636-1693.

BY PERLEY DERBY.

On March 3, 1636, four courts were ordered "to be kept every quarter, 1 at Ipswich to which Newbury shall belong, 2 at Salem to which Sangus shall belong, 3 at Newtown" (now Cambridge) "to which Charlestown, Concord, Medford, and Watertown shall belong, 4 at Boston to which Roxbury, Dorchester, Weymoruth and Hingham shall belong." These courts were "to be kept by such magistrates as shall be dwelling in or near the said towns, and by such other persons or worth as shall be from time to time appointed by the General Court." (Mass. Records, Vol. I, p. 169.)
In 1639, it was ordered that "County Courts" be established in each County; also "Strangers' or Merchants' Courts" were established (Mass. Colonial Laws, edition of 1660, p. 23). On March 3, 1687, "Courts of Sessions" mid the "Inferior Court of Common Pleas" were established.
The records of the County Court of Essex, at Salem, cover the period from Jan. 20, 1636 to 1692 and are in 42 volumes. A 43rd volume exists which contains miscellaneous papers from 1634 to 1693.
June 28, 1692, "Courts of General Sessions of the Peace" were ordered to be "held and kept in each county" and on Nov. 25, 1692, Quarter Sessions of the Peace" and "Inferior Court of Common Pleas" were established, but these acts were disallowed by the Privy Council, Aug. 22, 1695.
The records of the Inferior Court of Common Pleas for Essex run from 13 March, 1788 to 28 March, 1780, and are contained in fifteen volumes.
The records of the Court of General Sessions of the Peace cover the years from 27 June, 1698 to 12 Oct., 1819 and are in fifteen volumes.
These are the earliest Court Records in Essex County with the exception of two volumes covering the year 1692, made up of Witchcraft papers.
As none of those records are properly indexed the attempt is here made to supply an abstract of each case and a complete index to the first four volumes of County Court Records.
(The figures in parentheses refer to the page of the original volume, --EDITOR.)
