EXTRACTED FROM 1882 COMMISSIONERS' DEED:

Friday, October 13th, 1882

 The Honorable Clark Circuit Court met pursuant to adjournment at the Courthouse in the City of Jeffersonville, Indiana, on Friday the 13th day of October 1882, at 9 A.M.

Come the parties by their attorneys, Victor N. Lyon, John M. Cooper and William G. Armstrong, the commissioners herein, also come and present and acknowledge in open Court their report of partition, as follows:

We, the undersigned Commissioners, having been appointed by the most Honorable Circuit Court, at its June term, to make partition of the real estate among the heirs of Isaac Hale, Sr., deceased, we do herein submit the following writing and two plats marked "A" [and] "B", said writings and plats constitute our report.  Said Commissioners having been duly sworn make the following partitions of said real estate among the heirs of said Isaac Hale, Sr., deceased. . . .

GRAVE YARD
       "From the above described share [of Sarah A. Burd] No. 8, we reserve therefrom a tract of land now enclosed by a plank fence with cedar posts.  Said tract is now used as a family grave-yard; and is now reserved as a family grave yard to be used by all the heirs of Isaac Hale, Sr., deceased, and described more fully as follows, viz: beginning at the southwest corner of Sarah A. Burd's share at a stake near large beech; thence North 51 degrees 50 degrees East, 32.18 poles [a pole equals 16.5 feet, thus 32.18 poles is 530.97 feet] to a stake; thence North 28 degrees West 13.6 poles [224.4 feet] to a cedar post, the true place of beginning; thence North 28 degrees West 3.40 poles [56.1 feet] to a cedar post; thence North 24 degrees West 4.16 poles [68.64 feet] to a cedar post; thence South 59 degrees West 5.62 poles to the place of beginning.  Said tract contains 40 poles, more or less."
