Know all men by those presents that we Benjamin R. Folsom and Edmund Shafer of Tekamah, Burt County, and State of Nebraska, are hold and firmly bound unto the County of Burt and also to each and every person whose name is printed or written on the proposition and subscription hereunto attached, and who shall have paid their subscription according to the said proposition in the just and full sum of Three Thousand Dollars, lawful money of the United States to be paid to the County of Burt or to the said subscribers as the case may equitably be adjudged or to both or to their certain attorneys, executors, administrators, or assigns. For the payment whereof well and truly to be made we bind ourselves, our heirs, executors and administrator firmly by these presents. Dated this 12th day of October, A. D. 1877.
The condition of this, the above obligation, is such that if the above founders. Benjamin R. Folsom and Edmund Shafer, their heirs, executors or administrators, shall by a good and sufficient warranty deed convey to the county of Burt lots three (3) and four (4) in block ninety (90) in the Town of Tekamah, according to the original map and survey of said town, unless by the advice and consent of all the paying subscribers a different disposition as to title of said premises shall be made, in which case all the said subscribers are to have and to hold the same right and title to the said lots and building in proportion to the amount paid that we or either of us shall hold to perpetuity.
This obligation to convey the aforesaid lots also includes the building now being erected thereon intended for a County Court house with rooms also for County Officers, reserving in said deed the right to all the said subscribers, who pay as aforesaid, that whenever, if ever, the said premises shall be abandoned by
