The last will & testament of Hendrick H. Smith of the Town of Clermont, & County of Columbia.
In the name of God Amen I Hendrick H. Smith in the Town of Clermont, in the County of Columbia & in the State of New York being weak in body but of sound & perfect mind blessed by Almighty God for the same do make and publish this my last will & testament in manner & form following (that is to say) 1st I do will and order that the executors of this my last will and testament pay all my just debts and funeral charges out of my personally (sic) property as soon as convenient after my decease 2d I give and bequeath to my son Henry the place I now live on together with the waggon sleighs two horses plow & harrow & the harness belonging to the same in consideration of which he is to pay 130 pounds to be equally divided among all my children when my daughter Gitty becomes eighteen years of age. 3d My said son Henry shall keep his mother as long as she shall remain my widow & no longer. She shall receive the three fifths of the produce of the aforesaid place and he my son shall receive the remainder. She my said wife shall have one good horse and a right to keep the said horse on aforesaid farm with harness for the same. 4th after my youngest daughter becomes eighteen years of age the produce of the farm shall be equally divided between my said wife & son Henry each bearing an equal proportion of the expenses of said farm. 5th I do likewise give and bequeath to my dear and beloved wife as long as she lives Betsy my Negro wench who after the decease of my said wife shall make a choice of any of my children to live with. 6th I do likewise give & bequeath to my son Henry three of the eight acres of wood land lying in the Town of Red Hook the remaining five acres of said wood land I give and bequeath to the remainder of my children to be equally divided among them after they become of age. Lastly as to all the rest residue & remainder of my property goods & chattels of what kind or nature soever I give & bequeath the same to my wife & children to be equally among them, I do hereby appoint as my sole executors of this my last will & testament Henry my son, Garret Cock & Adam Clum hereby revoking all former wills & testaments by me made – in witness whereof I have hereunto set my hand & seal this 1st day of March in the year of our Lord Eighteen Hundred & Sixteen . signed sealed published and declared by the said Hendrick H. Smith to be his last will & testament in the presence of us who have hereunto subscribed our names as witnesses in the presence of the testator – the word “appoint” ninth line from the bottom was enterlined (sic) before signing the above the words remain my widow & no longer enterlined (sic) before signing the above. /s/ Hendrick H.
