Record of the last will and testament of Peter Smith, late of the City of Hudson, Columbia County, NY, deceased, as a will valid to pass real and personal property, and the decree admitting such will to probate. 

Recorded December 28, 1894.

     The last will and testament of Peter Smith of the city of Hudson, in the County of Columbia in the State of New York.

I Peter Smith, knowing the uncertainty of human life and being of sound and disposing mind, memory and understanding do hereby make, publish and declare my last will and testament in manner and form following, that is to say ­­­­­­­­­­­­­­­­­­

First . . . I order and direct that all my just debts and funeral expenses be paid as soon as conveniently may be after my decease.  

Second . . . I give and bequeath unto my daughter Emma J. Day, wife of James Henry Day, the sum of three hundred and fifty dollars.

Third . . . all the rest, residue and remainder of my estate, both real and personal and of whatsoever name and nature and wheresoever situated.  I give and bequeath unto my beloved wife Annie Smith to have and to hold to her, her heirs, executors, administrators and assigns forever.

Lastly I make, constitute and appoint my friend Henry Kertz of the City of Hudson aforesaid to be executor of this my last will and testament, hereby revoking all former wills by me made. 

In Witness Whereof.  I have hereunto subscribed my name and affixed my seal the seventh day of August in the year of our Lord one thousand eight hundred and ninety-four.

The following written and printed instrument consisting of two sheets was subscribed by the said Peter Smith in our presence and he then and there acknowledged to each of us that he had executed the same and he had at the same time declared the said instrument so subscribed by him to be his last will and testament and we at his request have signed our names as witnesses hereto in his presence and in the presence of each other and have so signed our names as witnesses on each sheet herein and written opposite our names our respective places of residence.
