This Indenture made this twelfth day of July the year of our Lord one thousand
eight hundred and eight Between Henry Massie of the County of Ross and State
of Ohio and James Carothers and John Patton both of the town of Lexington and
State of Virginia of the one part and Charles Walker and Elijah Walker of the
County of Highland and State of Ohio aforesaid of the other part and whereas
the aforesaid Henry Massie, James Carothers and John Patton purchased of and
recorded a deed from a certain James ????? Leitch for the the following ?????
other lands dated the twelfth day of November in the year one thousand eight
hundred and five and recorded in the County of Highland aforesaid and whereas
also the aforesaid James Carothers and John Patton have executed their power
of attorney to the said Henry Massie among other things to see and convey the
following among other lands as by reference had to the said powers seconded in
the County of Highland aforesaid ???? more freely ??????. Now therefore this
indenture authorized that the said Henry Massie as well for himself as
attorney in fact for the aforesaid James Carothers and John Patton for and in
consideration of the sum of seventeen hundred Dollars current money of the
United States to have in hand paid by the said Charles and Elijah Walker
before the sealing and delivering of these presents, the receipt whereof he
the said Henry Massie as the attorney as aforesaid doeth hereby acknowledge
and hereof doeth acquit, release and discharge the said Charles and Elijah
Walker, their heirs, executors and administrators and every of them ?????
haeth given, granted, bargained and sold, delivered, released, discharged and
confirmed and by these presents haeth give, grant, bargain, sell ????? release
?????? and confirm unto the said Charles and Elijah Walker, their heirs and
assigns forever the following tract or parcel of land lying and being in the
county of Highland and the State of Ohio on the waters of Brush Creek.
Beginning with a walnut sugartree and then the north east corner of Samuel
Whitleys tract of land and running thence south seventy seven and a half
degrees east two hundred and five poles to two white oaks, a hickory and a gum
tree, Thence south eight degrees west three hundred and thirty poles to two
white oaks and a red oak thence north eight one degrees west six hundred and
eleven poles to two hickorys and two dogwoods thence north nine degrees east
one hundred and eighty poles to two whiteoaks and a gum unto line of the said
Whitleys tract of land with his line south eighty one degrees east four
hundred and eight poles to two hickorys at the south east corner of the said
Whitely tract thence with another of his lines North nine degrees east four
hundred and eighty two poles to the Beginning, Containing eight hundred and
thirty five acres of land more or less. To have and to hold the said tract or
parcel of land that is to say one undivided moiety unto the said Charles
Walker his heirs and assigns forever and the remaining moiety to the said
Elijah Walker his heirs and assigns forever as tenants in common and not joint
tenants to them and each of their own proper use and behalf with the
proportions as aforesaid theirs and each of their heirs and assigns forever
and the said Henry Massie as well for himself and his heirs as attorney in
fact for the aforesaid James Carothers and John Patton theirs and each of
their heirs doeth hereby covenant and agree to and with the aforesaid Charles
and Elijah Walker and to them and each of their heirs and assigns to warrant
and forever defend the promises aforesaid against the claims of all and every
person or persons whatsoever. In witness whereof the said Henry Massie as well
for himself as attorney in fact as aforesaid hath hereunto set his hand and
seal and the hands and seals of the aforesaid James Carothers and John Patton
the day and year first above written.

before me Lewin Peet, President of the Court of Common Pleas for the second
circuit including the county aforesaid the before mentioned Henry Massie as
???? for himself as attorney in fact for James Carothers and John Patton as
mentioned in the foregoing deed acknowledged the foregoing instrument to be
his and their ????? deed executed for the purposes therein mentioned. Given
