The Will of Anthony FRANKLIN:
In the name of the Benevolent Father of all. I Anthony FRANKLIN of Highland
County Ohio, do publish this to be my last will and testament after my
funeral and doctor's bill is paid with all my just debts. I give to my
beloved wife her lifetime, all my real estate, that being my farm where I now
live on situated in Brush Creek Township in the County and State containing
about 100 acres, with all my goods, chattel, moneys and credits. Then at her
death; my land is to be sold with all the foods and chattels which is not
used or expended by my wife in her lifetime, all to be sold to the highest
responsible bidder, on half of the purchase money to be paid down, the other
half in one year with interest on the same, the payments to be secured by
good personal security. My daughter Susannah is to have fifteen hundred
dollars s her portion out of the first payment where the land is sold then
Mary JARNIGAN wife of Eli JARNIGAN is to have two hundred dollars. Then the
balance is to be equally divided between my other children whose name is as
follows Nelson FRANKLIN, Thomas FRANKLIN, Martha KEECH, Mary A. GARRETT,
Cyrus A. FRANKLIN and John W. FRANKLIN and if my beloved wife should die
before me, then at my death my goods, chattels, lands, and linements(?) is to
be divided and disposed of as before stated among the persons before named,
December 17th, 1855.

testament in our presence and signed by us in his presence.

The State of Ohio, Highland County Highland Probate Court
May 3rd A. D. 1859
This day the last will and testament of Anthony FRANKLIN late of Highland
County Ohio deceased was produced in open court by Joel L. FRANKLIN,
whereupon cause Martha KEECH (who relinquished her interest in said will for
the purpose of said will) and John L. HUGHES subscribing witness is thereto
who being first duly sworn depose and say that said testator at the time of
publishing and executing said last will and testament was over the age of
twenty-one years and of sound mind and memory and infirment that he,
voluntarily subscribed said last will and testament and in their presence and
hearing published and declared the same to be his last will and testament and
what they signed in his presence and at his request and that they signed it
in the presence of each and in his presence and he signed it in their
presence.
