Judiciary Hooper Estate. On June 15, 1872, Henry Hooper, a resident of Lafayette precinct, Nemaha County died intestate without any known heirs. On August 11, 1872 the court appointed Giles R. Reeder. After the settlement of the estate there was approximately $800 personal estate which the judge ordered Reeder to pay over to the estate as escheated estate. The legislature passed a special act constituting J. B. Piper, Eli Wood, Asa Day, Julius Gilbert and E. W. Thomas, trustees empowering and directing them to build a memorial school house in Nemaha County. May 24, 1875 the trustees accepted the trust. Reeder refused to deliver the personal and real property to the trustees. A suit was commenced in district court praying that a mandamus be issued commanding him to deliver the property. The case was tried in district court of Otoe County Dec. 21 and 22, 1875, Judge Gantt presiding. E. W. Thomas appeared for the trustees, J. S. Stull and J. H. Broady appeared for Reeder. Judge Gantt delivered the opinion that the governor is the only person who can pass the title to lands owned by the state. The mandamus was denied.

Judiciary Judge Lake, in deciding a motion concerning the jurisdiction of the State Court submitted by Mr. Poppleton yesterday, stated that if the State Constitution had been properly framed, no difficulty could have occurred in the transfer of cases from the Territorial to the State Courts. This was a stunner and a distinguished ancient of the legal family was seen to leave the court room in disgust.

Judiciary The riot case of the people of Nebraska vs Ida Warrens, Augustus Warrens, Ambrose Blckhardt, F. W. Rodenberger, and Nelson Berge, was tried on Tuesday from 1.30 P. M. until after midnight. The jury brought in a verdict of guilty. The court yesterday pronounced sentence against the defendants. August Warrens, $50 and cost of prosecution. Judiciary Trail and acquittal of Geo. Kearns on a charge of murdering Scott Kysinger on Jan. 26th at Plattsmouth. The case has created a good deal of excitement in Cass County The murder grew out of political differences, and these unfortunately brought political influences to bear heavily in favor of Kearns in the late trial which resulted in his acquittal against the clearest evidence. Kearns is an ex Federal, and the murdered man Scott was an ex-Confederate soldier. The two men appear to have been pitted against each other in Cass in political contests, and though they never spoke to each other save in sending defiant messages as fighting men, their first meeting resulted in an altercation which ended in the shooting and instant killing of Kysinger at the O. K. Saloon at Plattsmouth. The only provocation to the deed beyond stated, was that Kearns stated he had imposed upon his brother at some time and he would have revenge. In other words it was a cold blooded and atrocious murder. The prisoner, was arranged on the 28th, Judge George B. Lake presiding in Court. Sprague and Gen. Worthington were for the State, and Marguette, Clark and a small army of associates for the defense. Politics decided for Kearns that he was not guilty either of murder or manslaughter in killing Kysinger. Judge Lake ruled the defense into their seats once or twice before decent observance of legal proprieties could be enforced. Several jurors stood out against acquittal but finely yielded under outside pressure. Omaha Herald

Judiciary Trial of McFarland. For killing O'Brien in Nebraska City, resulted last week in a verdict of "Guilty of Manslaughter" and sentenced to four years in the State penitentiary. For stealing a horse a man is deemed worthy of being hung, or at best imprisoned for ten years, while four will amply compensate for taking the life of a fellow man. Judicial Nebraska City vs Covell. In behalf of the City Augustus Gerhardt, served an injunction on the salary of Prof. Covell as Superintendent of the public schools. The case was argued before Chief Justice Mason; Hon. S. H. Calhoun appearing for Covell and Stevenson and other lawyers in behalf of the City. Decision next Monday.

Judicial Nebraska Judges. Mason and Lake, are long time residents of Nebraska and each distinguished in the profession of law to that extent that his income from the practise of law was from 2 to 5 times greater than the $2000 salary which they obtain at Supreme Court. Judge Crouse, not so well known, is undoubtedly capable of making three or four times as much at the Bar in any State as his salary upon the bench. The Herald is against the present low salaries of the Judiciary - good lawyers make good judges and good lawyers cannot be induced to leave a good practice for Honor and a small consideration. A prominent newspaper at Lincoln has favored a convention for amending and revising the constitution of this State, at least two of the three Judges have declared they could not afford to sit longer on such a cheapbench. Judiciary. Gen. Boulware, A. Dray and Wm. Cliff were arrested a day or two ago in Kearney Ward for disturbing the quiet of that portion of Nebraska City. Boulware and Dray were fined each $25 and costs. There were some twenty men engaged in the melee and our marshal has warrants for their arrest.

Lake at the late term of the court, has been decided, dismissing the bill at the costs of the plaintiff. The property involved was 160 acres of land joining Lincoln worth $15000. Messrs. Calhoun, Croxton Stevenson, Hayward, Shambaugh, Minor, McC racken, Scofield, Sweet et al were employed on behalf of the plaintiffs and Wardell and Seymour on the defense.
